7 terms for using Pad.ma

1. Before reading the terms, you should know what is meant by "user", "material" and "annotations" on Pad.ma. A user is someone who has signed up and can share, upload, download, annotate material available on Pad.ma; a general user is someone who has not signed up and is browsing the website without registering.

Material is what is available on or via Pad.ma (including embedded links), which includes video (films, footage etc.), image, sound and text.

Annotations are all textual information made available via Pad.ma, including keyword, event, place, description, transcript, contributor, and information relating to map, source, project, topic, people. Annotations can also provide further information such as newspaper reports, (references) articles, related Material etc. Essays on Pad.ma will be included under annotations here.

2. These terms of service bind all users of Pad.ma, including the general user. The information provided by the user is protected by Pad.ma, and the user must also take reasonable care to not disclose her or his password. If you register or use the site then this constitutes an irrevocable waiver of any claim that you did not read, understand, or agree to these terms and conditions.

Pad.ma may amend these terms and conditions at any time simply by posting an amended version on this site and you are responsible for reviewing and understanding these changes.

3. By registering as a user on Pad.ma you can

- upload material that is then visible in a low resolution format (pixel width of 96p, 240p and/or 480p) via the Pad.ma website, and can be downloaded in a higher resolution ( generally pixel width of 480p or higher, depending on material).
- annotate material you have uploaded, or other material available on Pad.ma, but not edit other users' annotations. If you think there is a serious error then please contact pad.ma@pad.ma.
- download material in low, medium or high resolution, depending upon what license it is covered by.

As Pad.ma is an archival platform, your annotations should be useful, informative and not like comments on Youtube or Facebook. Please read the FAQ on annotations.

In relation to material downloaded from Pad.ma, the user can distribute, display, make copies, re-use in their own work or collection. The extent of these rights depends on the specific terms of the license applicable. (see Pad.ma General License and CC licenses)

Pad.ma can use material uploaded by you, for purposes such as the publicity of the website, or to make compilations, lists or for other similar purposes.

4. Copyright: As a user you can choose to upload your material under the Pad.ma General License or the Creative Commons License of your choice. We recommend that you upload under the Creative Commons License, Share-alike, Attribution, Commercial or Non-commercial V.3 applicable in India.

All material made available on Pad.ma shall be governed under the license chosen by the user and all annotations and essays shall be governed by the Pad.ma General License.

By using Pad.ma it is presumed that you have read and understood the Pad.ma General License, and the specific license applicable to the material on Pad.ma that you are annotating, downloading or altering in any way.

5. Obligations If you upload to Pad.ma you must have all the necessary rights to the material, and by doing so, you represent that you are not violating the personal or proprietary rights of any third party (including privacy rights). You agree to not upload material or make annotations that are unlawful, obscene, offensive, defamatory, threatening, or infringing of any copyright or other rights of others. You agree not to use the website to transmit or distribute any virus, worm, or other code that may be damaging to software or hardware, or to advertise or solicit via Pad.ma, without express permission. If you breach any of these conditions, then you indemnify Pad.ma against all liabilities and costs of any and every sort resulting from your breach. On Pad.ma, there is an option to upload material with Restricted view that does not allow other users to download the material but only view it online. Unless Restricted is expressly chosen, all material is available for viewing and download.

Pad.ma reserves the right to remove any content from the site at any time, for any reason (including if there are claims or allegations made by third parties or authorities in relation to the material, annotations or other information on Pad.ma), or if Pad.ma is concerned that any user has breached these terms of service.

6. License. You need to be familiar with the terms of the specific license under which material has been uploaded. This could be in reference to the Pad.ma General License, the Creative Commons Share-Alike, Attribution, Non-commercial or CC Share-alike, Attribution, Commercial license, which is displayed on the (view>info) information page for the Video. In India, these licenses can be chosen on the Creative Commons website.

If you redistribute any material, ideas and information in part or whole, got from the website of Pad.ma, it shall be your duty to inform all third parties about the terms and conditions that apply to such material and information from this terms of service as well as those arising out of the license that is applicable.

7. Representations, warranties and disclaimers

You understand and expressly agree that Pad.ma is a voluntary platform for sharing material and other information, and none of this can be construed as prescriptive advice or consultancy. As an archive of material, Pad.ma is not liable for any loss or suffering caused by relying upon information contained in the material, annotations or other information available on Pad.ma. All users of Pad.ma warrant that they have the necessary skill and judgment required to understand the material, and shall be solely liable for anything done in reliance of such material.

Pad.ma hereby disclaim all warranties and representations (whether express or implied) as to the accuracy of any information contained on the website or any material, annotations or other information on Pad.ma, and is not liable for any loss of profit, revenues, goodwill, opportunity, business, anticipated savings or other indirect or consequential loss of any kind in contract, tort (including negligence).

The ideas and information posted by users of Pad.ma, in the form of material, annotations or other information, do not necessarily reflect the views or opinions of Pad.ma.

Users of Pad.ma or Pad.ma may provide through the website (in the Material or annotations) hypertext links to other internet sites. By providing or permitting such a linking service, Pad.ma is not undertaking any responsibility or liability for any third party information or publications available on the internet, even if accessed through Pad.ma.

Pad.ma reserves the absolute right, which it may or may not exercise, to review, edit, or delete any material that it deems to be inappropriate or in violation of these terms and conditions. It further has the absolute right, in its sole discretion, to deny or to withdraw access to anyone who violates these terms and conditions.
