The rushed, daily schedule of city dwellers has been made much easier by the hawkers who sit on the pavements and road sides at vantage points, vending daily necessities. Hawkers are not new to the city, but are part of our society and traditions, they have given birth to many stories and add colour to our daily marketing, and more importantly, hawking is a source of livelihood for thousands of people who make their humble earning with dignity. Their absence can make our life more troublesome as we then need to walk that extra mile to the mall or shop plus buy the same thing at more expensive rates. They are a boon for the common city dweller in terms of their accessibility and affordability. Yet, many times, the state's legal authorities and some citizens refer to them as criminals and impediments to pedestrian and traffic movement. Uprooting hawkers completely negates their intricate relations with the common men in the city.

Recently, Layer Export Private Limited, committed an unlawful and unjust act against the hawkers in Malabar Hill sub-division. The company is trying to construct a high rise posh building and parking lot in the area which was reserved for a Municipal Retail Market in the statutory Development Plan. Under DC Rule 1967, the CRZ area is reserved for a retail market and no residential constructions or parking lots are permitted. The builder's plans violate many of the laws and overlook many necessary requirements of the area. It does not have the provision for a podium which will block the accessibility to the Retail Market and there is no separate space created or left to accommodate small Retail Markets, there is no place to plant trees- violation of DCR 23, the height of building is planned to be 118 meters instead of 41 meters as legally permitted and no mandatory FSI deduction is made on account of RG.

The law and the law keepers have turned their backs towards blatant violation of rules by builders whilst simultaneously becoming more and more intolerant towards the people living in penury. The law certainly seems to have decided whose city this is.
